Gomez Trial Attorneys to be recognized with four 2009 Outstanding Trial Lawyer Awards from The Consumer Attorneys of San Diego Organization

San Diego, CA. – The Consumer Attorneys of San Diego (CASD) organization will give out four Outstanding Trial Lawyer Awards in recognition of outstanding verdicts in connection with a jury trial to three attorneys at Gomez Trial Attorneys: John H. Gomez, Robert Hamparyan and James S. Iagmin at its annual Awards and Installation Dinner to be held at the U.S. Grant on October 29th.
According to CASD, the Outstanding Trial Lawyer Award is given to individuals based in San Diego, responsible for an outstanding verdict in connection with a jury trial involving a civil or criminal matter. The case must be tried to a verdict. Other criteria include ingenuity, liability aspects, service to the community and the amount of the verdict.

John Gomez and James S. Iagmin will receive the award for the case of La Framboise v. Krebs, et al. , which is the first case in California to apply the elder abuse statute to a commercial real estate transaction. The La Framboise family, after many years of working, purchased a building in  downtown San Diego, which represented a good portion of the retirement funds for the elderly parents. They hired a commercial broker, who also represented the buyer, resulting in the elderly Framboises being paid less for the property than should have been the case. In this precedent-setting case, Gomez Trial Attorneys attorney obtained a jury verdict of over $1 million dollars.

John H. Gomez will received the award a second time, along with Robert Hamparyan from Gomez Trial Attorneys for Young v. Hernandez, for which the attorneys obtained a $2.1 million verdict in federal court in a prisoner wrongful death case.  Also trying the case was Thomas Luneau.  The death of Johnny Young at Donovan State Penitentiary , came about when Mr. Young, mentally ill, was taken down in a yard upon failing to follow the guards’ instructions – dying minutes later.  The autopsy findings were consistent with an applied chokehold. The guards denied holding his neck, and the defense claimed Mr. Young died of “excited delirium” brought about by a psychotic outburst. Gomez Trial Attorneys was able to obtain a $2 million wrongful death verdict for his eldery mother; $100,000 were awarded to her for his  pre-death pain and suffering.

San Diego, CA. – La organización Consumer Attorneys of San Diego o CASD por sus siglas en inglés otorgará cuatro premios de Abogados Litigantes Sobresalientes del 2009 en reconocimiento a veredictos sobresalientes en relación a un juicio por jurado a tres abogados en el Despacho Gomez Trial Attorneys: John H. Gomez, Robert Hamparyan y James S. Iagmin en su cena anual que se realizará en el U.S. Grant el 29 de octubre.

De acuerdo a CASD, el Premio a Abogados Litigantes Sobresalientes se otorga a individuos basados en San Diego, responsables de lograr un veredicto sobresaliente en relación a un juicio por jurado en un caso civil o penal. El caso se deberá llevar a veredicto. Otros criterios incluyen aspectos de responsabilidad legal, servicio a la comunidad, y la cantidad del veredicto.
John Gomez y James S. Iagmin recibirán el premio por el caso de La Framboise v. Krebs, et  al., que viene a ser el primer caso en California que aplique el estatuto de maltrato de personas mayores a una transacción de bienes raíces comerciales. La Familia Framboise, quienes después de muchos anos compraron un edificio en el centro de San Diego, mismo que represento una porción significativa de los fondos de retiro para los padres mayores de edad. Contrataron a un corredor comercial, quien también representó al comprador, lo cuál resultó en que los Framboises, ya mayores, les pagarán menos por la propiedad de lo que debió haber sido el caso. En este caso, que se considera sin precedentes, el abogado del Despacho Jurídico Gomez Trial Attorneys obtuvo un veredicto por jurado de más de $1millon de dólares.

John H. Gomez recibirá el premio una segunda vez, junto con Robert Hamparyan de Gomez Trial Attorneys por el caso de Young v. Hernandez, en el cuál los abogados obtuvieron un veredicto de $2.1 millones de dólares en el tribunal en el caso de la muerte por negligencia de un reo. También participó en el enjuiciamiento Thomas Luneau.

La muerte de Johnny Young en la Penitenciaria Estatal de Donovan, ocurrió cuando el Senor Young, quien padecía de trastornos mentales, lo llevaron hasta el suelo por no seguir las instrucciones de los guardias, muriendo minutos después. Los hallazgos de la autopsia coinciden con que lo tomaron por el cuello aplicando presión.  Los guardias negaron haberlo tomado por el cuello y la defensa afirmaba que el Sr. Young habrá muerto de “delirio por excitación” resultado de un episodio psicótico. El Despacho Gomez Trial Attorneys logró obtener un veredicto de $2 millones de dólares por muerte por negligencia para su mamá, mayor de edad: le dieron $100,000 a su madre por el dolor y sufrimiento que padeció antes de morir.
