About the Pot Pie Recall
On October 9, 2007, ConAgra Foods issued a health warning about multiple brands of its frozen individual-serving pot pies, all made at the same plant in Missouri. Two days later, on October 11, the company issued a recall of the pies. The warning and eventual recall came after public health officials identified the pies as the source of an outbreak of salmonella that has sickened more than 170 Americans since January 1, 2007. So far, 33 people from various states have been hospitalized after eating ConAgra pot pies. The Centers for Disease Control and Prevention has launched an in-depth investigation of the ongoing outbreak.

Although chicken and turkey pot pies are the only ones proven to carry salmonella contamination, ConAgra Foods included beef pot pies in its recall to avoid confusion. The recalled pot pies have “P-9” or “Est. 1059” printed on the side and are all seven-ounce, individual-serving frozen pies. They carry the following brand names:

  • Banquet Pot Pies
  • Albertson’s Pot Pies
  • Food Lion Pot Pies
  • Meijer Pot Pies
  • Hill Country Fare Pot Pies
  • Great Value Pot Pies
  • Western Family Pot Pies
  • Kroger Pot Pies
  • Kirkwood Pot Pies

If you have purchased any of the brands of pot pies that are labeled with “P-9” or “Est. 1059”, do not eat them. Call the attorneys at the Gomez Law firm to discuss a possible pot pie salmonella lawsuit if you think you may already have been sickened by one of these pies. Try to save the packaging, receipts, credit card statements or any proof or purchase as well as any medical paperwork you may have showing that you were exposed to salmonella.

Salmonellosis

Eating food contaminated with salmonella causes an infection called salmonellosis, a type of food poisoning. People with salmonellosis develop vomiting, fever, diarrhea and cramps eight to 72 hours after eating the infected food. Most people recover within a week, but the infection may move to the bloodstream and other organs in young children, the elderly, people with compromised immune systems and anyone exposed to a very large amount of the bacterium. This is a life-threatening complication that requires hospitalization and prompt antibiotics. Salmonellosis causes 40,000 infections and 600 deaths in the United States each year.

ConAgra Foods has come under criticism for the two-day delay between its health warning and its recall. The initial warning did nothing to stop the spread of salmonella, because it did not require stores to take the pies out of their freezers. However, it did show that the company knew of the contamination before it took substantial steps to protect consumers, opening it to the possibility of serious legal penalties. Several food poisoning lawsuits related to the pot pies have already been filed against ConAgra, and savvy observers expect more.

When a manufacturer makes a defective product, it’s legally liable for the harm that product could do to consumers, regardless of whether it knew the product was harmful. If you or a loved one was sickened by a tainted ConAgra Foods pot pie, you have the right to sue the manufacturer over its carelessness. You may be entitled to recovery of all costs related to your illness, including medical bills and missed work, as well as payment for any lasting physical or emotional damage it caused. Call The Gomez Law Firm today to speak with an experienced food poisoning attorney about your case.
