A jury awarded Dawn Kali $105,356,000, holding self-proclaimed cancer expert Robert Young responsible for fraudulently and negligently representing cancer treatments that led to her cancer’s progression.
Kali had been diagnosed with Stage I breast cancer and was desperately in search of answers when she sought the care of Young of pH Miracle Living, who claimed to provide treatments that would cure her cancer. Kali flew to San Diego and paid over $2,000 per night at the pH Miracle Living ranch and paid $500 for each round of intravenous infusion treatment, sodium bicarbonate-baking soda.
Evidence presented at trial showed that Young intentionally and negligently misrepresented these treatments. June Asisi, pH Miracle Living’s accountant, testified in the trial that she had heard Young promise patients he could cure their cancer. After reasonably following Young’s treatments and false promises, which led her to forego any additional treatment, Kali’s cancer progressed. Now, she has Stage IV cancer, and her life expectancy is four years.
The jury found that Young’s negligence and fraud caused her injuries, awarding Kali $576,000 in past medical expenses, $280,000 in future medical expenses, $5 million in noneconomic damages, $84.5 million in future noneconomic damages, and $15 million in punitive damages. The case was presided by the Honorable John S. Meyer.
