Sharp Grossmont Hospital Invasion of Privacy Lawsuit

During the time frame of July 30, 2012 and June 30, 2013, Sharp Grossmont Hospital installed and operated hidden cameras in the operating rooms of the Women’s Health Center. Sharp secretly recorded approximately 1,800 procedures using these cameras. The hidden cameras recorded everything that happened in the operating rooms whenever anyone entered the room. If your privacy has been infringed upon by any medical care provider don’t hesitate to contact the San Diego medical malpractice lawyers at Gomez Trial Attorneys.

Because of this, there were video images taken of:

• Patients entering and exiting the operating rooms;
• Patients undergoing surgical treatment;
• Patients giving birth (including, but not limited to, birth complications, dilatation and curettage to resolve miscarriages, hysterectomies, sterilizations, and other medical procedures);
• Patients undressing and dressing;
• Patients in their most intimate moments, unconscious or exposing body parts such as parts of their genitals or parts of their breasts; and
• Any friends or family members that were in the operating rooms.

Who was affected?

If you delivered a baby or had any surgical procedure at Sharp Grossmont Hospital Women’s Health Center (5555 Grossmont Center Drive, La Mesa, CA 91942) during the time frame of July 30, 2012 and June 30, 2013, you may have been videotaped without your consent or knowledge.

Are there copies of the videos that were taken?

There might be approximately 15,000 videos of patients in Sharp’s operating rooms were taken. Approximately 7,000 videos were retained. Sharp allegedly destroyed some of the videos as well. As your lawyers, we can help obtain a copy of any recording that may exist of you.

Do I need to hire a lawyer?

If you would like to pursue any monetary damages for invasion of your privacy, you should hire a lawyer to prosecute your claims. This case is not a class action and you will need to file a separate lawsuit to preserve your rights. Many women have already come forward, and we expect that hundreds more will join to hold Sharp accountable for its actions. To make sure you get accurately and fairly represented learn how you should select your personal injury attorney before making your decision.

Why did Sharp do this?

Sharp claims this secret video surveillance was necessary as part of its investigation into whether someone was stealing the anesthesia drug Propofol from drug carts in operating rooms. Despite this, Sharp’s cameras were set up to record when anyone entered an operating room, including patients. The lawsuits allege that there were numerous other ways of trying to determine whether drugs were being stolen that did not require the secret videotaping of women and families in their most vulnerable states.

Sharp admits that it installed hidden cameras in the operating rooms but denies that it invaded patients’ privacy. We are filing lawsuits on behalf of numerous women and families for the invasion of privacy into some of their most intimate moments in life.

What rights did I have to privacy?

Sharp’s own list of “Patient Rights,” among other things, promised the following:

• Full consideration of privacy concerning you’re their medical care program;
• Case discussion, examination and treatment are confidential and should be conducted discreetly;
• Patients have a right to be advised as to the reason for the presence of any individual;
• Patients have a right to have their personal privacy respected;
• Patients have a right to confidential treatment of all communications and records pertaining to their care and stay in the hospital;
• Sharp promised that written permission shall be obtained before medical records are made available to anyone not directly concerned with your care.

In addition to the Patient Rights set forth by Sharp, the lawsuits affirmatively allege that you had a reasonable expectation of privacy during your medical procedure and that Sharp should respect that privacy.
